R2Dmax is a GPS/GSM driven micro-controller designed to manage, display, record and transmit the live activities associated with the non-commercial dispensing and receiving of liquid kerosene fuels like diesel and paraffin in both mobile and fixed installations, the web based interface is tailored to display the data in a user friendly manner offering an array of essential and convenient reports both live and historic.

This product is offered to you on condition that you accept, without modification or reservation, all of the terms, conditions, and notices contained herein.

Exclusive Obligation

This product has been designed for a variety of uses but was not designed to meet any national or international standards, nor any independently accredited institutions specifications, nor was it manufactured as a product for commercial or lethal usage, nor any other harmful purposes. Accordingly, this product may not be used for any unlawful purposes or any usage that is expressly prohibited under these terms and conditions.

Use limitation

You may not modify, copy, distribute, private label, rebrand, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell, any information, Application Program Interface, API software and data, general software, products or services obtained, from Digit Bulk (PTY) Ltd. website or its products outside of any intended written offering and contract of service directly with Digit Bulk (PTY) Ltd.

Limited Replacement Warranty

This product is warranted against any manufacturing defect for a period of twelve months from date of purchase.

High Risk Activity

Products sold by Digit Bulk (PTY) Ltd include equipment used in hazardous environments such as fuel monitoring and dispensing applications. Participation in this activity is always associated with high risk levels. Risks include, but are not limited to, serious physical and other injury, disability and/or death. Your participation in this activity is always at your own risk.

Assumption of Risk

By buying, using, or allowing the use of Digit Bulk (PTY) Ltd products, you hereby acknowledge, understand and agree that fuel dispensing activities including fitment of product, operation of product and use pf monitoring equipment, to the extent permitted by law, YOU EXPRESSLY AND VOLUNTARILY ASSUME THE RISK OF DEATH OR PERSONAL OR OTHER INJURY WHILST PARTICIPATING IN SUCH ACTIVITIES, WHETHER OR NOT CAUSED BY THE NEGLIGENCE OR OTHER FAULT OF Digit Bulk (PTY) Ltd including but not limited to equipment malfunction from whatever cause, or any other fault of Digit Bulk (PTY) Ltd. Additionally, you agree to indemnify, defend, and hold Digit Bulk (PTY) Ltd. harmless from any third-party claims arising from such High-Risk Activities or any other Digit Bulk (PTY) Ltd. No claim shall be made against Digit Bulk (Pty) Ltd for any such loss or damage arising out of negligence whatsoever.

Device Modification

Modification to devices, such as controller, power supply, flowmeter or flow solenoid through the use or misuse of Digit Bulk (PTY) Ltd. products can lead to device malfunction causing serious risk. Risks include but are not limited to controller damage, serious physical injury, disability and/or death. You are responsible for and assume all risk for any modifications that you perform on your or anyone else’s installation using Digit Bulk (PTY) Ltd. products. Digit Bulk (PTY) Ltd shall not be responsible and will not be held liable for any claim arising out of modifications to installations, through the use or misuse of its product, especially if the modifications include (but are not limited to), bypassing or eliminating safety features, installing parts not recommended by the manufacturer safety regulation and standards, and/or improper installation and adjustment of Digit Bulk (PTY) Ltd. products.

Limitation of Liability

As set forth above under the limited warranty provisions, Digit Bulk (PTY) Ltd liability shall be limited strictly to the repair or replacement of its products which are returned to it within the specified period of time. In no event shall Digit Bulk (PTY) Ltd.’s liability exceed the value of the product(s) sold. In no event shall Digit Bulk (PTY) Ltd, its employees, directors, agents and or suppliers be liable for any direct, indirect, punitive, incidental, special or consequential damages whatsoever arising out of or connected with the use or misuse of any of its products, web sites or related services. Digit Bulk (PTY) Ltd relies on a host of third party service providers to transmit, interpret and capture data, under no circumstances will Digit Bulk be held liable for any loss, breach or break in transmission of such data whether it be directly or indirectly related to any services supplied directly or indirectly from Digit Bulk (PTY) Ltd. In no event shall Digit Bulk (PTY) Ltd be considered a data storage facility the onus lies on the user of our products to continually download and store such data on a regular daily basis.

Warning

Use and misuse of products sold by Digit Bulk (PTY) Ltd involves serious risks including injury, disability and death. Purchasers assume all risks. Inspect Before Each Use. This product must be inspected for use to ensure it has not been damaged in shipment. If damaged, do not use and immediately return the product to Digit Bulk (PTY) Ltd for a replacement.

Entire Obligation

The PRODUCT LIABILITY DISCLAIMER document states the entire obligation of Digit Bulk (PTY) Ltd with respect to the products. If any part of this disclaimer is determined to be void, invalid, unenforceable or illegal, including, but not limited to the warranty disclaimers and liability disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and, the remainder of the agreement shall remain in full force and effect.

Applicable Law

Your order from Digit Bulk (PTY) Ltd., and this disclaimer statement are governed by the laws of the South Africa. You hereby consent to the jurisdiction and of the High Court of Pretoria, South Africa, in all disputes arising out of or relating to the use of this product.

Modification of Terms and Conditions

Digit Bulk (PTY) Ltd. reserves the right to change the terms, conditions, and notices under which its products are offered, under certain circumstances.
